New Delhi (Gurpreet Singh): A Delhi court has directed that fresh summons be issued to YouTuber Dhruv Rathee in a defamation case filed in 2018 by BJP IT Cell member Vikas Pandey. The court passed the order on October 12 after hearing a plea seeking fresh steps to serve the summons on Rathee.
Judicial Magistrate Rahul Jain noted that the complainant had been trying to serve Rathee for several years. The court directed that fresh summons be issued at his address in Gurugram, Haryana.
The case dates back to 2018, when Pandey filed a defamation complaint after Rathee uploaded a video about him on YouTube.
Why Did The Delhi Court Issue Fresh Summons To Dhruv Rathee?
The court was hearing an application filed by Pandey seeking fresh summons to Rathee. His counsel, Advocate Samaksh Sharma, submitted that Rathee ordinarily resides in Austria and had travelled to India to attend protests in the national capital.
Sharma argued that fresh summons were necessary so that steps could be taken to serve them promptly.
In its October 12 order, the court observed that the complainant had been attempting to serve Rathee for several years. It also noted that Rathee had initially been summoned in July 2019.
The court subsequently directed that fresh summons be issued at his Gurugram address.
What Is The 2018 Defamation Case Against Dhruv Rathee?
The complaint was filed by Vikas Pandey, a member of the BJP’s IT Cell, in 2018 after Rathee published a video concerning him on his YouTube channel.
The fresh summons relate to the ongoing legal proceedings in that complaint. The order concerns the process of serving summons and does not, by itself, establish that Rathee is guilty of defamation.
What Happens Next In The Case?
The fresh summons are to be issued to Rathee at his Gurugram address. Further proceedings will depend on the progress of the case and the court’s subsequent directions.
The matter remains a defamation complaint, and the allegations must be assessed through the legal process.
