Edmonton (Rajeev Sharma): A company involved in constructing the west Edmonton Light Rail Transit (LRT) extension has been fined $120,000 following a serious workplace injury on a major transit project site.
Marigold Infrastructure Partners Inc., acting as the employer, pleaded guilty on May 26 in the Edmonton Court of Justice to one count under Alberta’s Occupational Health and Safety (OHS) Code. The charge related to failing to ensure equipment or material was properly contained, restrained, or protected to eliminate potential danger in the workplace.
As part of the proceedings, the Crown withdrew 13 additional charges. Charges against related entities, including Marigold Infrastructure Partners Limited Partnership and Marigold Infrastructure Partners LP, were also withdrawn. The case stems from an incident on June 23, 2023, on the Edmonton Valley West Line LRT project. According to court records, workers were carrying out post-tensioning work on a section of the rail line when a worker was struck by equipment and suffered serious injuries. The court imposed a fine of $120,000, which includes the victim fine surcharge. Both the company and the Crown have up to 30 days to appeal the conviction or the penalty.
Alberta’s Occupational Health and Safety laws establish mandatory safety standards for workplaces across the province, requiring employers to take necessary precautions to protect workers. Charges are typically laid when safety violations result in serious injury or fatality.
