Mumbai (Rajeev Sharma): The Bombay High Court has granted relief to a Pune-based sweets outlet by lifting the suspension of its food licence and directing the Maharashtra Food and Drug Administration to pay ₹5 lakh to the business.
Gurunanak Dairy and Sweets in Wadgaon-Sheri had faced regulatory action after an inspection on June 12 pointed to multiple shortcomings concerning sanitation and hygiene at the premises. Based on those findings, the food licence of the establishment was suspended.
The shop subsequently submitted a compliance report outlining the corrective measures it had taken. When officials conducted another inspection on July 13, the establishment was found to have addressed almost all the deficiencies identified earlier.
The re-inspection report showed compliance with 35 of the 36 parameters assessed, translating into 98 per cent compliance with the prescribed requirements.
The High Court took note of the significant improvement and questioned the justification for keeping the licence suspended despite the establishment having substantially met the required food safety and hygiene standards.
The court consequently set aside the continued suspension and allowed Gurunanak Dairy and Sweets to resume business.
In addition to restoring the establishment’s ability to operate, the court ordered the Maharashtra FDA to pay ₹5 lakh within 30 days.
The ruling came after the court examined the regulatory action taken against the shop and the subsequent compliance achieved following the initial inspection.
