Supreme Court Constitutes Committee to Safeguard Rights of Transgender Persons in India

New Delhi, October 17, 2025: The Supreme Court on Friday formed a high-level committee and issued guidelines to protect the rights of transgender persons across India. The bench, led by Justice J B Pardiwala, stated that the committee will focus on equal opportunities, inclusive healthcare, and protection for gender non-conforming and gender-diverse individuals.

The committee will be headed by former Delhi High Court judge Justice Asha Menon and include transgender activist Grace Banu, Akai Padmashali, CLPR Bengaluru member Gaurav Mandal, and Dr Sanjay Sharma from the Association for Transgender Health in India. Senior Advocate Jayna Kothari has been appointed as amicus curiae to assist the court.

Until a comprehensive national policy is formulated by the Union government, all institutions without their own transgender inclusion policies are directed to follow the Supreme Court’s guidelines.

Justice Pardiwala said, “This will go a long way in protecting the rights of transgender persons. We are hopeful that the future of the third gender is secure with this judgment.”

The ruling followed a plea by a transgender woman challenging her termination, with the court noting serious concerns over how two private schools had terminated her employment.
