India Enacts Immigration and Foreigners Act, 2025: Key Reforms and Implications

New Delhi (Rajeev Sharma): India has officially implemented the Immigration and Foreigners Act, 2025, repealing several colonial-era laws, including the Foreigners Act of 1946 and the Passport (Entry into India) Act of 1920. This new legislation aims to modernize India’s immigration framework, enhance national security, and streamline the entry, stay, and exit processes for foreign nationals.
Enhanced Penalties for Immigration Offenses: Individuals found using forged or fraudulently obtained travel documents will face imprisonment ranging from two to seven years, along with fines between ₹1 lakh and ₹10 lakh.
Hotels, educational institutions, hospitals, and nursing homes are required to report information about foreigners to assist authorities in monitoring those who overstay their visas. International airlines, shipping companies, and other carriers must submit advance passenger and crew information to immigration authorities upon arrival at Indian ports or airports. The Act provides exemptions for certain groups, such as members of the Indian Armed Forces and their accompanying family members, who are entering or leaving India on duty.
The implementation of the Immigration and Foreigners Act, 2025, introduces significant changes for foreign nationals residing in or visiting India. Individuals must adhere strictly to visa conditions, and overstaying or violating visa terms may result in severe penalties. Foreign nationals are encouraged to stay informed about the new regulations and ensure compliance to avoid legal complications.
Union Home Minister Amit Shah emphasized that the new legislation is crucial for strengthening national security and enhancing India’s global standing. He highlighted the importance of knowing who enters the country, when they enter, for how long they stay, and the purpose of their visit. The government views the Act as a step towards making India a more secure and globally integrated nation.
