Bhopal (National Times): In a significant legal development, the Madhya Pradesh High Court has ordered the registration of an FIR against BJP leader and State Cabinet Minister Kunwar Vijay Shah over his controversial and communal remarks targeting Colonel Sofiya Qureshi, a key officer involved in Operation Sindoor.
Taking suo motu cognizance, the Division Bench of the High Court issued the directive after video clips of Shah’s speech at a public gathering in Ramkunda village went viral on social media, triggering widespread outrage. In his speech, Shah allegedly made derogatory and inflammatory remarks questioning Col. Qureshi’s background and loyalty.
Communal Undertones Prompt Judicial Intervention
The High Court observed that the minister’s statements appeared to be divisive in nature and could potentially incite communal disharmony, especially given Col. Qureshi’s role in a high-stakes national military operation.
“The court has taken serious note of the remarks, which appear to undermine the integrity and honour of a decorated military officer based on communal overtones,” said Advocate Rameshwar Thakur, who was present during the hearing. “The bench has directed that criminal proceedings be initiated under relevant sections of the Indian Penal Code.”
Sections Invoked Under IPC
Though the official FIR is yet to be registered at the time of writing, legal experts anticipate that charges may include sections related to promoting enmity between groups (Section 153A), defamation (Section 500), and outraging the modesty of a person (Section 509), among others.
Widespread Condemnation
Shah’s comments drew severe backlash from opposition leaders, retired military officers, civil society groups, and veterans’ associations, who called them a direct attack on the armed forces and communal harmony. Many demanded an unconditional apology and immediate resignation of the minister.
Colonel Qureshi’s Silence Speaks Loud
Colonel Sofiya Qureshi, known for her distinguished military service, has so far not issued a public statement. However, sources close to her said that she was “saddened and disappointed” by the personal nature of the attack, especially in light of her commitment to national service.
The High Court’s decision to intervene without a formal petition is being hailed as a bold move to uphold justice and protect the dignity of armed forces personnel. The case now moves into the investigation phase, with police directed to file a formal FIR and submit a progress report to the court within a stipulated timeframe.
